APPLICATION FOR BUILDING PERMIT

ALL YOU NEED TO KNOW ABOUT APPLICATION FOR BUILDING PERMIT:-
1.0     PREPARATION OF DRAWINGS:
All drawings submitted to the Board for development permit must be countersigned by relevant Professionals. Eg. Architect, Engineer. Town Planner.
1.1     TYPE OF DRAWINGS REQUIRED:
          a.       Floor Plan
          b.       All elevations
          c.       Sections
          d.       Roof Plans
          e.       Structural drawing (Story Building)
          f.       Electrical drawings
          g.       Locational/site block plan
          h.       Survey/Site Plan.
          i.        Septic tank and soak-away drawings.
          In all cases 4 sets of the drawings are required while all the drawing must be at suitable scales, acceptable to relevant Professionals.
1.2     DOCUMENTS REQUIRED:
          (i)      In addition to the drawings certain documents are required. These are:
a.       Right of Occupancy (R of O) either State (i.e statutory R of O) or Local Government Customary Right of Occupancy Customary R of O.
b.       Letter of Allocation with evidence of payments in exceptional case.
c.       Certificate of Occupancy (C of O).
d.       Approval of Assignment/Approval for change of use.
(ii)     Where land is outside government interest, the documents required are:
a.       Local agreement supported by a sworn affidavit in a Court of Law.
b.       Deed of Assignment
c.       Evidence of inheritance (If it is a family land).
(iii)     Environmental Impact Assessment Report (EIAR) is required in all cases where the structure involved is expected to have a noteworthy impact on the environment based on the size or type of use. Environmental Impact Assessment Reports (EIAR) are for major Projects such as commercial, Public Projects, Private buildings above two floors.
1.3     TYPES OF APPLICATION:
          a.       Residential Building
          b.       Residential/Commercial
          c.       Commercial
          d.       Industrial
          e.       Public Buildings.
          f.       Temporary Structure.
1.4     SUBMISSION OF APPLICATIONS:
          The Board has Area/Zonal Offices in the following Areas:
          1.       Lokoja Area Office:        Lokoja Local Government
          2.       Ugwolawo:                     Ofu Local Government Area
          3.       Ankpa:                            Ankpa Local Government Area
          4.       Idah:                               Idah/Ibaji Local Government Areas
          5.       Okene:                            Okene Local Government Area
          6.       Ajaokuta:                        Ajaokuta Local Government Area
          7.       Ogori/Magongo:            Ogori/Magongo Local Government Area
          8.       Kabba:                            Kabba/Bunu Local Government Area
          9.       Isanlu:                             Yagba East Local Government Area
          10.     Odo-Ere:                         Odo-Ere     Axis
          11.     Egbe:                              Egbe      Axis
          12.     Iyara:                              Ijumu Local Government Area
          13.     Koton-Karfe:                  Kogi Local Government Area
          14.     Ayangba:                        Dekina/Bassa Local Government Area
          15.     Obangede:                     Okehi Local Government Area
          16.     Mopa:                             Mopa/Amuro Local Government Area
          17.     Ogaminana                    Adavi Local Government Area
          18.     Zariagi:                            Zango Daji, Kabba Junction, Obajana  Axis
          19.     Okpo:                                Olamaboro Local Government Area

          21.     Omala:                            Omala Local Government Area.
2.0     PROCEDURE FOR BUILDING PLAN APPROVAL:
a.       Plans are submitted to relevant Area/Zonal Offices.
b.       Registration, Inspection and Processing fees paid.
c.       Site Inspection/Report.


d.       Building Plans are charted on developers’ plot contained in the layout provided by the Ministry of Environment and Physical Development, while site Analysis Report are provided for sites outside approved layout.
e.       Building Plans are processed and approved in the absence of query. If queried, the plans are withdrawn for amendments before resubmission
f.       Public building, Commercial and Storey buildings above two floors are referred to headquarters.
g.       Plans are approved with or without condition.
h.       Approved plans are dispatched and collected from the office of submission by the depositor.
2.1     PENALTY:
Penalty fees are charged when construction commenced before approval is given (60% of approval fees).
2.2     RENEWAL:
The life span of an approved building plan is two Calendar years. The building plan approval will be considered for renewal or revalidation if construction of the building is not completed within this period (2 Years).
3.0     LODGING OF COMPLAINTS:
Applicant can lodge their complaints to the Area Officer concerned or the General Manager of the Board.
The Public is to note that the Town Planning and Development Board is not in charge of Land Administration and therefore does not confer land title. Hence, any development permit given will be withdrawn should any document/information supplied by you be found to be false or if such a withdrawal is in public interest.
4.0     PENALTIES FOR CONTRAVENTION:
According to the Kogi State Town Planning and Development Board’s Edict No. 5 of 1991 and infact the Nigeria Urban and Regional Planning law Decree No. 88 of 1992, and amended in 1999, states no development shall be commenced by anybody, Government or its agencies without obtaining an approval from the relevant development control department. Any developer that contravenes this law and embarks on the construction of illegal structures is liable to be charged 60% of the approval fees, if the development is approvable or be demolished, among other possible sanctions.
Demolition of any erected illegal structure will be at the expense of the owner or developer.
4.5     ISSUES THAT MAY DELAY THE PROCESSING OF BUILDING PLANS:
          a.       Ensure that sites are not within the area of Government interest.
b.       Ensure that they submit the layout plans of the area where the plot is situated.
c.       Ensure that they maintain proper set-back from the road.
d.       Ensure that site are not under high tension, electricity line, on NNPC Pipe line or railway set-back.
e.       Make sure that registered Architect, registered Town Planner and registered Engineer signed the design as the case may be. 
4.6     PROCEDURE FOR STREET NAMING:
          1.       Submission of application.
          2.       Inspection/investigation of claim of the applicant concerning:-
                   a.       Length of stay of the applicant on the street.
b.       His contribution to the development of the street and the community.
c.       The acceptance of the street name by the majority of the residents.
         3.     Site Report/Recommendation.
          4.       Final approval.
